Please read this agreement carefully. By purchasing, booking, enrolling in, or receiving services provided by Ann Arbor Holistic Health (AAHH), you agree that you have read and understood these terms.
Introduction
AAHH provides wellness consultations and coaching, wellness therapies, and longevity spa services. AAHH does not provide physician medical care. Diagnosis and medical treatment of illness or disease are outside the scope of AAHH services. You should consult an appropriately licensed medical provider for diagnosis, treatment, or other medical care.
If you have a medical emergency, call 911 or seek appropriate emergency medical care. AAHH does not provide emergency medical services.
You agree to provide AAHH with complete and accurate information about your health history, medical conditions, medications, and other information reasonably requested in connection with the services you receive.
You are responsible for your own health
You remain responsible for your healthcare decisions and for obtaining appropriate medical care. AAHH may provide education, wellness services, and support, but does not guarantee any particular health outcome, improvement, or result.
When intake, screening, or consent forms are required, you agree to complete them accurately and on time. AAHH may decline or reschedule a service if required forms or information are incomplete.
Age and Minor Clients
You must be at least 18 years old to enter into this Agreement on your own behalf. If you are under 18, a parent or legal guardian must review and accept these Terms and any applicable Enrollment Forms or Consent Forms on your behalf.
AAHH may establish minimum age requirements for particular services or require a parent or legal guardian to be present during some or all of a minor's appointment. Certain services may not be available to minors or may require additional consent, screening, or approval before they may be provided.
A parent or legal guardian who authorizes services for a minor represents that they have the legal authority to provide that authorization and accepts responsibility for payment for those services.
Wellness Therapies and Assumption of Risk
Wellness Therapies at AAHH may involve equipment, physical activity, heat, pressure, light, electrical or electromagnetic energy, compression, or other modalities depending on the service. Each service may involve its own risks, contraindications, and eligibility requirements.
You agree to complete any screening or Consent Form required for the service and to follow reasonable instructions provided by AAHH staff or practitioners.
By choosing to receive a Wellness Therapy, you acknowledge and voluntarily assume the inherent risks associated with that service, including the risks described in the applicable Consent Form.
You agree to promptly tell AAHH about any discomfort, unusual symptoms, change in your health, or other circumstance that may affect whether a service is appropriate for you. AAHH may decline, modify, discontinue, or reschedule a service when reasonably necessary for safety.
No Guaranteed Results or Warranties
AAHH will provide its services with reasonable care and skill. Except as otherwise required by law, AAHH makes no other warranty, express or implied, regarding any service, therapy, device, information, product, or outcome.
AAHH does not guarantee the accuracy of laboratory results or other information produced by third-party laboratories, manufacturers, interpreting professionals, or service providers.
AAHH does not guarantee that any service, therapy, device, product, supplement, or wellness recommendation will produce a particular result or be appropriate or effective for every individual.
AAHH is not responsible for injury or adverse effects resulting from failure to follow instructions regarding the proper use of equipment, products, or Wellness Therapies.
Information provided by AAHH through consultations, websites, handouts, brochures, educational materials, or other communications is intended for educational purposes. Information may change over time and should not be considered a substitute for individualized medical care when medical care is appropriate.
Products, Educational Information and Affiliate Relationships.
AAHH may provide educational information about supplements, products, therapies, or services that may be relevant to your wellness goals. This information is provided for educational purposes and should not be considered medical advice or a substitute for medical care.
AAHH may sell products directly or provide links through which products or services may be purchased. AAHH sometimes uses affiliate or referral links and may receive a commission or other compensation if you make a purchase through those links, at no additional cost to you.
The decision to purchase or use any product is yours. Individual responses to supplements, products, and therapies vary, and AAHH does not guarantee that any particular product will be safe, appropriate, or effective for you.
Privacy & Communications
AAHH treats your personal and health information as private and confidential and uses reasonable safeguards to protect it.
Information may be shared or disclosed when reasonably necessary to provide the services you request, including with AAHH personnel, independent contractors, laboratories, interpreting professionals, technology providers, payment processors, and other service providers involved in delivering or supporting your services. Information may also be disclosed when you authorize the disclosure or when disclosure is required or permitted by law.
AAHH may communicate with you through email, text message, client portals, electronic forms, or other methods used in the ordinary course of providing services. These forms of electronic communication may carry privacy or security risks that cannot be completely eliminated. If you do not want AAHH to communicate with you through a particular method, you are responsible for notifying AAHH of that preference.
You may take personal notes during a session, but you may not audio-record, video-record, photograph, livestream, or otherwise record a session without prior written permission from AAHH.
Fees, Payment Plans, Cancellations and Refunds
You will be informed of the fees associated with the services you are purchasing or requesting before you are charged. You are responsible for paying those fees according to the payment terms disclosed to you at the time of booking, purchase, or enrollment.
If you agree to a payment plan, recurring membership, or other scheduled payment arrangement, you authorize AAHH to charge your payment method according to the payment schedule disclosed to and accepted by you. You are responsible for keeping your payment information current.
A late-payment fee may apply when disclosed as part of the applicable payment or enrollment terms. Services may be suspended when a required payment remains unpaid. To the extent permitted by law, you are responsible for reasonable costs incurred in collecting amounts that are properly due and unpaid.
Appointments are subject to the cancellation, rescheduling, and no-show policy disclosed to you at the time of booking or enrollment. Different services may have different cancellation requirements based on appointment length, practitioner availability, equipment use, or other considerations.
By scheduling an appointment, you agree to the cancellation policy applicable to that appointment and authorize AAHH to charge any cancellation or no-show fee disclosed to you when you book.
Refund eligibility for Wellness Plans, laboratory services, memberships, packages, or other programs is governed by the terms applicable to the specific service or program purchased, as disclosed to you at the time of booking, purchase, or enrollment..
Health insurance & HSA/FSA Payments
AAHH does not bill or participate with health insurance and does not guarantee reimbursement.
AAHH cannot guarantee that any costs related to any services or products sold will be covered by your HSA or FSA account. It is your responsibility to determine HSA or FSA eligibility for any expenses you choose to use your card for.
Lab Testing Clients Only
This section applies only if you have ordered laboratory testing through AAHH.
AAHH may facilitate access to laboratory testing and provide educational or nutritional interpretation of laboratory results within the scope of AAHH's services. AAHH does not use laboratory results to diagnose, treat, or cure disease.
Laboratory testing is performed by independent laboratories. Reference ranges, measurements, accuracy, specimen requirements, processing times, and other aspects of laboratory testing are determined by the laboratory performing the test. AAHH does not control and does not guarantee the accuracy or completeness of laboratory results.
You are responsible for providing laboratory results to your physician or other appropriately licensed medical provider when medical interpretation, diagnosis, or treatment is needed. A physician or other qualified medical provider may interpret the same laboratory findings differently or use them for purposes outside the scope of AAHH's services.
The presence of a physician's name on a laboratory report does not necessarily mean that the physician personally reviewed or medically interpreted your results.
You agree to provide complete and accurate health information relevant to interpretation of your laboratory results. AAHH may postpone a Lab Review if required intake forms, laboratory testing, or other requested information has not been completed.
You should consult the appropriate licensed medical provider before making changes to prescription medications or other medically directed treatment. AAHH does not prescribe medication or direct changes to prescription medications.
Unless otherwise stated in your purchase or enrollment terms, Lab Review services must be completed within 3 months of purchase. You may request a refund within 14 days after purchase. Unused laboratory test kits must be returned when applicable and may be subject, along with related Lab Review fees, subject to a 20% restocking & administrative fee. Laboratory fees are non-refundable after a test kit has been used or a specimen has been submitted.
You are responsible for following the collection and submission instructions provided for each laboratory test and for completing testing within any timeframe communicated by AAHH or the laboratory.
Wellness Coaching Plan Clients Only
This section applies only if you have enrolled in a Functional Wellness Plan with AAHH.
AAHH's Functional Wellness Plans focus on education, nutrition and lifestyle guidance, wellness coaching, and other non-medical wellness strategies. AAHH does not diagnose or treat disease through a Wellness Plan and does not guarantee protection from illness or any particular health outcome.
AAHH's wellness coaching is not a substitute for medical nutrition therapy or other medical care. If you are receiving medical nutrition therapy, following a medically prescribed diet, or receiving care for a medical condition, you agree to continue working with the appropriately licensed medical professional responsible for that care and to inform AAHH of relevant recommendations, restrictions, or changes.
A Wellness Plan is a fixed-length program and is not a guarantee of a particular number of practitioner sessions unless expressly stated otherwise in your Enrollment Form. Unless otherwise stated in your Enrollment Form, services included in a Wellness Plan must be completed no later than one month after the stated length of the Plan. For example, services included in a six-month Wellness Plan must generally be completed within seven months of enrollment.
You may request a refund within the first 14 days after purchase. Any approved Wellness Plan refund is subject to a processing & administrative fee equal to 10% of the total Wellness Plan price, except where otherwise required by law.
Some Wellness Plans allow payment over time. A payment plan is a method of paying the total purchase price and is not a pay-as-you-go arrangement. You remain responsible for the full price of the Wellness Plan you purchased even if you select an installment payment option, subject to any applicable cancellation or refund rights.
For ongoing programs such as Continued Wellness or Continued Wellness Light, the scheduling, use, rollover, cancellation, and expiration of services will be governed by the terms disclosed for that program. Tune Up sessions must be completed within the applicable period disclosed at purchase or enrollment.
Limitation of Liability and Assumption of Risk
You understand that individual responses to wellness services, devices, supplements, products, and other therapies vary and cannot always be predicted. By choosing to receive services from AAHH, you knowingly and voluntarily accept the inherent risks associated with the services you select, as further described in any applicable Consent Form.
To the maximum extent permitted by law, AAHH is not responsible for injury, loss, or damages resulting from:
risks inherent in a service that were disclosed to you or that are reasonably associated with that service;
incomplete, inaccurate, or omitted health or medication information provided by you;
your failure to follow safety instructions or other reasonable directions;
misuse of equipment, products, supplements, or therapies;
laboratory errors or information produced by an independent laboratory or other third party;
products or services provided by third parties that are not under AAHH's direction or control; or
your decision to rely on educational information from AAHH instead of obtaining medical care when medical evaluation, diagnosis, or treatment is appropriate.
To the maximum extent permitted by law, AAHH will not be liable for indirect, incidental, special, or consequential damages arising from services provided by AAHH.
Nothing in these Terms is intended to waive or limit any right or liability that cannot legally be waived or limited under applicable law.
AAHH's Right to Decline, Stop or Reschedule Services
AAHH may decline, discontinue, shorten, postpone, or reschedule a service when reasonably necessary for your safety, the safety of others, or the appropriate operation of the Wellness Center.
This may include, but is not limited to, situations involving: a potential contraindication or safety concern; incomplete, inaccurate, or missing intake, screening, or consent forms; symptoms or circumstances that make it inappropriate to continue a service; failure to follow reasonable safety or staff instructions; equipment malfunction, maintenance, or unavailability; disruptive, threatening, abusive, inappropriate, or unsafe behavior; or other circumstances that AAHH reasonably determines make it inadvisable to begin or continue the service.
If AAHH stops or reschedules a service because of an equipment problem or another circumstance within AAHH's control, AAHH will make reasonable efforts to reschedule the service or provide an appropriate credit or refund for the unused service. This does not apply when a service is declined or stopped because of a client's conduct, a contraindication, incomplete required information, or failure to follow safety instructions.
Service-Specific Forms and Order of Precedence
Certain AAHH services require additional Enrollment Forms, Consent Forms, health screenings, waivers, or other service-specific agreements. Those documents are incorporated into these Terms and form part of your agreement with AAHH.
If there is a conflict between these Terms and a service-specific Consent Form or Enrollment Form, the service-specific document will control with respect to the particular service or subject addressed by that document.
If you enter into a separate written agreement governing the price, payment schedule, duration, included services, or other terms of a particular Wellness Plan, membership, package, or program, that agreement will control with respect to those specific terms.
All other provisions of these Terms will remain in effect.
Electronic Acceptance and Records
You agree that these Terms and any Enrollment Forms, Consent Forms, acknowledgments, or other agreements with AAHH may be presented, accepted, and signed electronically.
Clicking an acceptance box, providing an electronic signature, completing an electronic enrollment or consent process, or otherwise electronically indicating your agreement will have the same effect as signing a paper document.
AAHH may maintain electronic records showing the documents and versions presented to you, the date and time of your acceptance, and your electronic signature or other indication of agreement. You agree that these electronic records may be used as evidence of your acceptance.
Changes to These Terms
AAHH may update these Terms from time to time as our services, policies, or legal requirements change.
The version of these Terms in effect when you purchase, enroll in, or receive a service will apply to that service unless you subsequently agree to an updated version.
For ongoing memberships, plans, or services, AAHH may provide updated Terms electronically. Changes that materially affect payment obligations, cancellation rights, liability, privacy, or other material rights or obligations may require your affirmative electronic acceptance before you purchase or receive additional services. Other changes will become effective after reasonable notice. Changes will apply prospectively and will not alter material terms already agreed upon for a previously purchased fixed-term service or program unless you agree to the change.
Your continued booking or use of AAHH services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
Governing Law
These Terms and your relationship with AAHH are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.
To the extent a dispute between you and AAHH is brought in court, you agree that it will be brought in a court of appropriate jurisdiction located in Washtenaw County, Michigan, unless applicable law requires otherwise.
Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. To the extent permitted by law, the invalid or unenforceable provision will be interpreted or modified as narrowly as necessary to make it enforceable while preserving its intended purpose.
Complete Agreement
These Terms, together with any applicable Enrollment Forms, Consent Forms, service-specific agreements, membership or program agreements, and other documents expressly incorporated into them, constitute the complete agreement between you and AAHH concerning the services you receive.
If there is a conflict between these documents, the order-of-precedence provisions above will apply. No verbal statement or informal communication changes these Terms unless AAHH and you expressly agree to the change in writing or electronically.
